There are two major consequences associated with recognising the
changing orientation of the daylight/darkness line as a property of the Earth's orbital motion. 1 - The observed rotational emergence of the observer out of the Earth's orbital shadow and the changing orientation of the daylight /darkness line tangential to the Sun/Earth line. 2 - The major error in determining the components of the Equation of Time where that shift in the daylight/darkness line as a property of the Earth's orbital orientation is ignored in favor of the axial tilt component which is a property of the Earth's equatorial orientation. Comments on issue 1. The direction of the Earth's orbital motion in the direction of the daylight/darkness line (dawn) is best appreceated by the following graphic http://www.mhhe.com/physsci/astronom...ages/04f15.jpg The arrow constitutes the division of the Earth's orbital shadow from direct light received from the Sun as is always tangential to the orbital plane.The shift in direction of the line is conditioned by Kepler's second law insofar as the anglular difference varies over the course of an annual orbit. As axial rotation is constant and moves in and out of an orbital shadow that is varying its orientation to the Sun,the result is that the longitude meridians which are fixed to the 24 hour/360 degree equivalency vary in the time it takes to align with the Sun/Earth line (noon). Kepler's second law allied to to the shift in the daylight/darkness line constitute the major component of the variable unequal day as observed by the noon determination when a longitude meridian axially rotates to face the Sun directly along it polar axis.
