His last words to me, " You hard ass, I'm going to court and get an injunction to keep you from setting up on MY sidewalk ". Starlord, Bummer. Isn't Foster Freeze a franchise? I wonder if it would be worth contacting the main Foster Freeze folks. It would be interesting to know what the owner's real issue is. Or e-mail? How about a public-minded attorney serving him with a cease and desist letter? How about this-----surely somewhere in the local, county, or state ordinances, it states that sidewalks are PUBLIC property, not the property of adjacent landowners. What about presenting him with a copy of such an ordinance? |

I've always been told that on a paved steet, with sidewalks, that from
the curb to 10ft in is public access sidewalk / right of way. With this sidewalk being close to or over 15ft wide, I've always stayed within that 10ft area. I figure that since the cops couldn't make me move, I've got some part of the law on my side. I'm going to have to do some calling and leg work to find out some details. He'll not miss it, but no longer will I spend my money in there, I'll go across the street to am-pm for my drink. and no, that sidewalk is to narror to set up on, it's not much more than 3ft wide. If I was a business owner and someone was willing to set up for free and draw people to my area, I sure wouldn't be chasing them away. Don't let them get you down. No, he's not getting me down. To many times in the past I've let
people run over me only to find out later on that I had rights I could have stood on. Not deal with astronomy, but other things I've done. But this time I've dug in and I will hold the line, and I'm already making up a flyer I can start posting all over town, figure I just might hit where it'll count, the pocket book. There are probably a number of people reading your message who would be willing to write some letters supporting your cause, if you could provide at least some basic information about the situation, such as who you are (I'm not going to write a letter saying "quit bugging 'Starlord'"), in what town you are doing this, on what street, etc. We're not psychic and don't know these things, and your message did not provide them. I wish you good luck in your battle with the jerk from "Foster Freeze" (whatever that is). |

Home: Rosamond,CA. Yes, just over 6 years ago I started setting up, at that time a Stargazer Steve 4.25in F9 Dob that had been given to me by luckers right here on S.A.A.. The place I set up is the corner of Rosamond Blvd and B St. It's a wide Sidewalk and corner. For most of the time I used that Dob, while my Babylon 8 project was in the works. During fall, winter, spring I've mostly set up on maybe friday night and always on Saterday night. When Summer comes I sometimes set up during the week, as their hours go up by one hour a night. This last May, they had a deal where they allowed some Vet group to have a rally for support of the troops, the women who must be part owner said I couldn't set up then, as the group was setting up a big PA system, I moved my scope down the sidewalk to between the two front driveways. That's when she went from nice to not nice, she was the first to say they owned the whole sidewalk, and if I didn't go, she would call the Sheriff's. Which she did because I would not go away, she was also the first that ever said I had never gone in to ask them if I could set up on the Public Sidewalk. The Sheriff's came, before they even got there, she took off, so they talked to whoever the crew manager in the shop is. Then came out to me, they didn't even say anything about moving, they talked Astronomy with me. When back in, then went to their car and left. This Saterday was their car rally night, they close up the parking lot and only old car people get in. They set up a BIG BBQ on the sidewalk close to where I set up last month. They sell BBQ meat plates most the night. I was just setting up when this guy made a beeline to me, and just as I was placing the tube on the rocker box, he tells me that I can no longer set up there EVER. That HE owns the whole Sidewalk and if I didn't leave, he'd call the Sheriff's. I just said I was staying. By the time I was fully set up, and had been for about 20 mins they showed up and the same thing went on, only he had stayed and he must have really laid a lot on them. They came to me and asked what I did, I told them, they then said they couldn't force me, but made the suggestion to move across the street and set up under the trees by the school yard, but I held to my spot. He then told them my truck was parked in a no parking zone, so I moved it, yet the rest of that night many other cars and trucks parked there, ( Sign says No Parking on Pavement ) I had been 100% on dirt. On the other side of B St, it's NO PARKING at all, yet the same thing happened, cars,etc. parked during the whole time and not one parking ticket was given out. But just as the cops where leaving, he comes over and tells me he's going to get a court order to stop me from setting up. I never got his name, and it's not on anything inside that's displayed in the shop. At the same time he don't have my address either. It's odd, that after that deal in May, I set up as before on the other weekends and nothing was ever said to me.
