Note that citing cases or opinions won't answer the question, because you cited the Constitution here. Saying "constitutionally proper" is not the same as saying "it is spelled out verbatim in the Constitution". I maintain that the rock *is* listed as the defendant. And you're still wrong, and will continue to be wrong so long as you maintain this belief, and you won't be any less wrong with repetition.
