NASA is a civilian agency. It comes under an entirely separate
Congressional budget line and is overseen by different committees
than the Dept. of Defense. Most NASA technical information is
controlled under ITAR, but science results are public. The Mars
rovers and Mars Global Surveyor have non-NASA principal
investigators. I haven't counted, but I expect that's true of most
NASA science instruments.

As someone else noted, the new Cydonia picture comes from ESA, not
NASA.

You have not responded to the fact that the picture was not
released by NASA but by the ESA, which is not American
and not at all under the jurisdiction of the Dept. of Defense.

Nothing there suggests science data can be withheld. In practice,
they never are.

Some missions have proprietary periods, when the PI -- not "NASA" --
has exclusive access to the data. This allows time for thoughtful
analysis and publication, and the PI is free, indeed encouraged, to
publish as soon as possible. After the proprietary period, science
data are freely available to anyone.
